Bitland and Kraken dismissed BCH's monopoly lawsuit, saying it did not exist

Bitland has asked lawyers to file a motion to dismiss and the plaintiffs have responded

In December 2018, the headquarters is located in Miami the United American Corp (otc market code: UAMA) announced that it had started for mainland bits of litigation, the company believes Bitcoin.com, Roger Ver, Kraken encryption currency exchange and other individuals, through elaborate plan control BCH network for personal interests, damage the interests of the company and other BCH stakeholders.

The Block reported on April 21 that The defendants have now asked their lawyers to file a motion of dismissal, which is an application to a judge to dismiss The plaintiffs' claim through defense. The plaintiffs have also responded. Whatever the Supreme Court decides, the way these issues are framed is thought-provoking and could have implications for other current or future disputes.

United American Corp in litigation wrote, "the defendant effectively seized currency cash (BCH) network, focused BCH market, a violation of the COINS since the birth of all accepted standards, protocols, and behavior of the process. They are a thorough and coordinated plan, lead to the global market value of more than $40, and leads to many American COINS, including the plaintiff holders suffer and irreparable damage...... in addition, the world economy, especially the U.S. economy, have significant long-term effects." The plaintiffs also argue that the allegations described in the complaint are sufficient to infer that a trade agreement was entered into between the defendants, which constitutes antitrust action under section 1 of the Sherman Act.

Bitland says United American Corp's suit is untenable because it is based on speculation and does not provide any evidence of a monopoly or any agreement between the defendants in the suit.

Bitland also argued that United American Corp had failed to defend itself against complaints that it restricted trade or harmed competition, as required by the antitrust suit. "None of the alleged injuries [by the plaintiffs] reflect any harm to market competition. After the bifurcations, the Bitoin SV continues to exist and is traded on exchanges with hundreds of other cryptocurrencies: it is also proof that" voting represents competition in its truest form, not lack of competition."

Bitland also argued that there was nothing to support the plaintiffs' conclusion that the BCH decline was due not to macroeconomic forces but to the upgrading of the BCH.

Kraken said it did not participate in the so-called "monopoly agreement" and that the rise or fall of the currency was determined by the market. They also argue that United American Corp's antitrust case is pointless because it makes no sense for Kraken to do anything to depress BSV prices, and that exchanges make the most money in markets where prices are rising. Moreover, they argue that the choice of a particular product, standard or service does not violate antitrust laws.

The plaintiffs, United American Corp., responded to the defendants' arguments.

It is important to note here that in the case of a motion by the defendant to dismiss the plaintiff's action, the plaintiff only needs to defend the facts, and if the facts are deemed to be true, the plaintiff can file a claim. United American Corp said the facts showed that "the defendants made clear statements that they coordinated, conspired and agreed to one another." These facts include: bitminer redeployed as many as 90,000 Antminer S9 units in November 2018 to facilitate a conspiracy between Roger Ver, Bitcoin.com, wu jihan, and bitminer. The plaintiffs claim (based on a YouTube video) that all this was a "maneuver" with Kraken in advance.

The plaintiffs' demand for compensation is that "the defendants misrepresented to the plaintiffs and the market that they would comply with the [Satoshi] white paper and accept the standards and the agreement."
