According to Dynamic Beating monitoring, on the 4th day of the Musk v. OpenAI court hearing, the biggest highlight shifted to xAI. OpenAI's lawyer asked Musk whether xAI had ever distilled OpenAI's technology. Musk initially stated, "Almost all AI companies do this," but when pressed for a clear answer, he admitted that "some had." The Verge reported that this essentially confirms that xAI had used OpenAI's model to enhance its own model.
Distillation is when one AI model is used to train another model. While this is a common training method, if competitors use it to cheaply replicate the capabilities of a strong model, it can lead to copyright, terms of service, and commercial competition disputes.
