The day before, the two parties engaged in a heated exchange on Twitter, with Musk even running promoted tweets to disparage Altman. Musk argued in court that he was responding to OpenAI's initial public post, prompting the judge to suggest a "fresh start from today," which Musk, Altman, and Brockman agreed to.
The trial officially entered the opening statement phase. The jury will review years of emails, texts, and company documents among OpenAI founders to determine if the leadership deviated from its founding principles during the shift towards profitability and acceptance of Microsoft's investment. Expected witnesses include Microsoft CEO Nadella, former OpenAI executives Mira Murati and Ilya Sutskever, as well as Musk's children's mother and former OpenAI director Shivon Zilis. The jury is expected to begin deliberations by May 12th.
