At that time, the court will determine whether the disclosure statement provides enough information for creditors to make informed votes on the plan. The court will also determine whether the debtor is authorized to solicit votes on the plan and arrange for a confirmation hearing. The debtor has requested that the confirmation hearing be scheduled for September 29th. On July 17th, the debtor, the creditors' committee, the special group for borrowers, and certain Earn creditors will mediate with Judge Wiles on the relative treatment of Earn and loans in the plan.
