BPI stated that its application was made in accordance with relevant provisions of the New York Civil Practice Law and Rules and had not previously made a similar application to any court.
According to the submitted documents, BPI fully denies the main allegations in the plaintiff's complaint in the intended answer, only acknowledging that the plaintiff is seeking a declaratory judgment through this case. For other allegations, BPI either denies them or states that there is insufficient information to form a judgment. BPI also introduced itself as an organization established in 2021, headquartered in Washington, D.C., and a non-partisan, non-profit organization focused on researching the policy and social impact of Bitcoin and emerging currency networks. The institute conducts independent research and is not influenced by industry participants such as cryptocurrency companies or exchanges.
The case has attracted market attention as it involves an anonymous individual attempting to use legal processes to claim a significant amount of Bitcoin allegedly owned by Satoshi Nakamoto. With BPI's application to intervene as a defendant, the organization stated that it will oppose the plaintiff's related claims and seek to have the entire lawsuit dismissed.
