Elon Musk Loses Century-Long Lawsuit to Ultraman, Vows to Appeal Citing "Calendar Trap"

According to Sentiency Beating monitoring, a nine-person jury at the California Oakland Federal Court unanimously ruled that Elon Musk, sued too late, completely lost the lawsuit against OpenAI and Sam Altman. Presiding Judge Yvonne Gonzalez Rogers promptly dismissed Musk's entire claims in court.

Due to missing the three-year statute of limitations, Musk's carefully prepared key arguments such as "breach of charitable trust" and "executive undue enrichment" did not even get a day in court.

An OpenAI spokesperson outside the court called the ruling a "great victory," with their attorney boldly stating that Musk's accusations were "completely divorced from reality, pure nonsense."

Musk then fired back fiercely on X platform, dismissing the judgment as a "calendar trick." He insisted without a doubt that Altman and CEO Greg Brockman indeed "pocketed millions by looting a charitable organization."

His attorney Marc Toberoff made the strongest statement outside the court: "One word — appeal. This war is not over."

He reiterated the lawsuit's core: under no circumstances should anyone be allowed to raise millions under the guise of public charity, only to later morph into a for-profit entity when the time is right, enriching executives in the process. If they are let off the hook this time, the defense line of charitable organizations will crumble.

Despite Musk's vow to fight on, several senior appellate lawyers have pointed out that it is extremely challenging for the appellate court to overturn the jury's statute of limitations determination. This legal marathon, which is crucial to OpenAI's compliance transformation and Musk's reputation, will drag on in the Ninth Circuit Court of Appeals.
