The Justice Department subsequently appealed to the federal appeals court, requesting an additional 90-day grace period for the appeals court to provide time for the executive and legislative branches to consider options, with a total delay of up to about four months. However, the federal circuit court of appeals has rejected the Justice Department's request, meaning that the subsequent steps of the tariff refund process can be quickly initiated.
This decision by the federal appeals court clears the way for the lower court, the U.S. International Trade Court, to initiate legal proceedings related to tariff refunds. According to Justice Department lawyers, the refund process may take several years to complete. Following the Supreme Court's ruling, hundreds of additional companies have filed lawsuits for tariff refunds, bringing the total number of tariff cases faced by the Trump administration to over 2,000.
